1. About this agreement
1.1 This End User Licence Agreement ("Agreement") is between you and Saris Technology Ltd, a company registered in England and Wales (company number 16116406), whose registered office is at 2 Rectory Croft, Church Lawton, Cheshire, ST7 3FE, United Kingdom ("we", "us", "our").
1.2 It covers the video game Horizon Overdrive, including its software, updates, patches, downloadable content, online features and any related documentation (together, the "Game").
1.3 By installing, accessing or playing the Game you agree to this Agreement. If you do not agree, do not install or play the Game; you may be able to obtain a refund under the policy of the store you bought it from (see section 10).
1.4 If you are under 18, or under the age of majority where you live, a parent or guardian must read and agree to this Agreement on your behalf.
1.5 You obtained the Game through a digital store or platform (for example Steam, the Epic Games Store, GOG, Microsoft Store, PlayStation Store or Nintendo eShop) (a "Platform"). The Platform's own terms also apply to you; see section 15.
2. Your licence
2.1 We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game for your own personal, non-commercial entertainment, on devices you own or control, as permitted by the Platform you obtained it from.
2.2 The Game is licensed, not sold. You own the medium or account entitlement through which you access it, but not the Game itself.
2.3 Streaming and videos. You may stream, record and share videos and screenshots of yourself playing the Game, including on monetised channels, as long as you do not suggest that we endorse you and you do not distribute the Game's music or other content separately from gameplay. Some licensed music in the Game may be claimed automatically by video platforms; if so, you can switch music off in the Game's settings.
3. What you may not do
Except to the extent the law expressly allows it despite this restriction, you must not:
(a) copy, sell, rent, lease, sublicense, distribute or otherwise transfer the Game or any part of it;
(b) reverse engineer, decompile, disassemble or create derivative works from the Game;
(c) remove, alter or hide any copyright, trademark or other notice in the Game;
(d) use cheats, bots, automation, exploits or modified game files to gain an advantage in online features, or to interfere with other players' enjoyment of the Game (in-game cheat options we provide are allowed; see section 7);
(e) attempt to gain unauthorised access to our servers, other players' accounts or any data not intended for you, or interfere with the operation of our online services;
(f) use the Game for any commercial purpose (for example in an arcade, internet café or paid event) without our written permission; or
(g) use the Game in breach of any law.
4. Ownership
4.1 We and our licensors own all rights in the Game, including its code, cars, worlds, artwork, music, sound, text and characters, and all trademarks, logos and trade names in it. All rights not expressly granted to you in this Agreement are reserved.
4.2 In-game items, currencies, unlocks, progress, scores and similar ("Virtual Items") have no real-world monetary value, cannot be sold or exchanged for money, and are licensed to you as part of the Game. They are not your property.
5. Online features
5.1 Some features of the Game connect to the internet, including online leaderboards, online races and, where available, shared liveries ("Online Features"). Online races use Epic Online Services together with the Platform's online services; leaderboards and shared liveries use servers operated by us or our service providers.
5.2 Online Features may require a Platform account, a network connection and, on some Platforms, a paid Platform subscription.
5.3 We will try to keep Online Features available, but we do not promise that they will be uninterrupted or error-free. We may change, suspend or end any Online Feature. Where we intend to end one permanently, we will give at least 90 days' notice in the Game or on its store page, unless we must end it sooner for legal, security or third-party reasons. The rest of the Game will continue to work offline.
5.4 We may remove scores or times from leaderboards that we reasonably believe were set in breach of this Agreement, or that are clearly the result of a bug or exploit.
6. Content you create and share
6.1 The Game lets you create content — for example car liveries and their decals — and share it with other players: other players in an online race see your car's livery, and, where the Game allows, you can share a livery or a public display name more widely ("Your Content").
6.2 You keep any rights you have in Your Content. By sharing it through the Game, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example to fit other screens) and distribute Your Content, in the Game and in materials promoting the Game, for as long as it remains shared, and for a reasonable time afterwards for backups and promotional material already made.
6.3 The rules. You must not share content, or choose a display name, that:
(a) is illegal, or promotes or helps anyone break the law;
(b) promotes hatred of, or violence against, people because of their race, ethnicity, nationality, religion, disability, sex, sexual orientation or gender identity — including hate symbols, and numbers or codes used as hate symbols where that is clearly their meaning;
(c) supports a terrorist or violent extremist organisation, including its flags, emblems or slogans;
(d) is sexual, sexually suggestive or crude (for example drawings of genitals or sexual acts);
(e) bullies, harasses, threatens or mocks a particular person;
(f) promotes suicide, self-harm, eating disorders, illegal drugs or dangerous stunts;
(g) impersonates anyone, including us or another player;
(h) contains personal information about anyone, including contact details; or
(i) infringes anyone else's rights, including trademarks and copyright.
The Game is played by people of all ages, including children. If you would not want a child to see it, do not share it.
6.4 How we moderate. We do not check content before it reaches other players, except where the Game says it does. The Game limits what can be made — shapes from a fixed library, no uploaded images, no chat — and may check names against a list of banned words. We review content that is reported to us. Where the Game shows a livery to many players, content reported by several different players may be hidden automatically until we have reviewed it. When several different players report a player's content, a temporary Sharing Restriction (section 6.5) may be applied automatically. A person decides every permanent restriction and every appeal.
6.5 What we can do. If we reasonably believe content or a display name breaks section 6.3, we may hide or remove it, show your display name as the default name, and restrict your ability to share content with other players ("Sharing Restriction"). While a Sharing Restriction applies, other players see your car without your decals and you cannot share liveries, but you can still play the whole Game, online and offline, and keep and use your own liveries on your own device. A Sharing Restriction lasts 7 days the first time, 30 days the second time and may be made permanent the third time, counting over 12 months. Content reported as illegal may lead to a 30-day restriction straight away, and to a permanent one. We report content we believe is seriously illegal to the police or other authorities. Section 17.2 still applies to serious or repeated breaches of this Agreement as a whole.
6.6 Telling you why. When we hide or remove your content or apply a Sharing Restriction, we will tell you in the Game: what we did, the facts behind it, the rule in section 6.3 (or the law) it broke, whether automated means were used, and how to appeal — unless the law prevents us, or telling you would help someone cause harm.
6.7 Reporting content. If you see content or a display name in the Game that you think breaks these rules or is illegal, report it at https://saristechnology.co.uk/horizonoverdrive/report/. That page also explains what to include in a report of illegal content. If you believe content in the Game infringes your rights, report it the same way.
6.8 Appeals and complaints. If you disagree with a decision about your content or account, or with how we handled a report you made, you can appeal within 6 months through the same page. A person will look at the decision again and tell you the outcome. If we got it wrong, we will restore your content and lift any restriction. This does not affect your right to go to court, or to use any other dispute resolution open to you.
7. Cheats and fair play
The Game includes optional cheat settings that we provide. You may use them freely. While a cheat that affects results is switched on, your runs are not submitted to online leaderboards and do not count toward progression; this is intended behaviour, not a fault.
8. Updates and changes to the Game
8.1 We may release updates, patches and new content, which may be downloaded automatically by your Platform. Some updates may be required to keep playing online.
8.2 Updates may change, add or remove features, rebalance gameplay, or reset leaderboards. We will not make changes that materially reduce the Game you paid for without a valid reason (such as a legal, security or technical requirement), and where the law gives you rights in that situation, those rights apply.
9. Your data and privacy
9.1 How we collect and use personal data is explained in our Privacy Policy at https://saristechnology.co.uk/horizonoverdrive/privacy/. Please read it; it is information about your rights, not extra terms you are agreeing to.
9.2 In summary: online leaderboards store your best times against an anonymous ID and your Platform account ID, and can be switched off or erased in the Game's settings. Online races use Epic Online Services. Players on public test branches of the Game may choose to send anonymous performance summaries (loading times, frame rates, hardware); the released version of the Game does not send them.
10. Purchases and refunds
10.1 You buy the Game and any paid content from the Platform, not from us. Prices, payment and refunds are handled by the Platform under its own policies.
10.2 Nothing in this section affects your statutory rights (see section 11).
11. Your statutory rights
If you are a consumer, you have legal rights in relation to digital content that is faulty or not as described — in the UK, under the Consumer Rights Act 2015, and elsewhere under the consumer law of your country. Nothing in this Agreement affects those rights or limits any right that cannot lawfully be limited. Advice about your legal rights is available from your local consumer advice organisation (in the UK, Citizens Advice).
12. Warranties
12.1 Subject to section 11, the Game is provided "as is" and "as available". To the extent the law allows, we make no other warranties or promises about the Game, express or implied, including that it will be uninterrupted, error-free, compatible with every device or configuration, or that any Online Feature will remain available.
12.2 Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
13. Our liability to you
13.1 Nothing in this Agreement limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
13.2 If we fail to comply with this Agreement, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
13.3 If digital content we supply damages a device or other digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. We will not be liable for damage you could have avoided by following our advice to apply an update offered to you free of charge, or by meeting the minimum system requirements we published.
13.4 The Game is for domestic and private use only. To the extent the law allows, we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
13.5 Subject to 13.1 and section 11, and to the extent the law allows, our total liability to you under or in connection with this Agreement will not exceed the greater of the price you paid for the Game and £50.
14. Third-party software and licensors
14.1 The Game is built with Unreal® Engine and uses Epic Online Services, and includes other software and content licensed from third parties. Horizon Overdrive uses the Unreal® Engine. Unreal® is a trademark or registered trademark of Epic Games, Inc. in the United States of America and elsewhere. Unreal® Engine, Copyright 1998 – 2026, Epic Games, Inc. All rights reserved. Other third-party notices are listed in the Game's installation folder.
14.2 Epic Games, Inc. and our other licensors make no representations or warranties to you, and Epic Games, Inc., its licensors and its and their affiliates disclaim all representations, warranties, conditions and liabilities related to the Unreal® Engine technology and the Epic Online Services software included in the Game. Any claim you have about the Game is against us, not them. Sections 12 and 13 apply to our licensors as they apply to us, and they may rely on those sections. Nothing in this section limits the rights described in section 11 or the liability described in section 13.1.
15. Platform terms
Your use of the Game through a Platform is also governed by that Platform's terms of service. If this Agreement conflicts with the Platform's terms about the Platform's own services (for example its accounts, store, refunds, friends lists or multiplayer networking), the Platform's terms apply to that extent.
16. Health and safety
A very small number of people may experience seizures when exposed to certain light patterns or flashing lights, including those in video games, even with no history of epilepsy. If you or anyone in your family has an epileptic condition, consult a doctor before playing. Stop playing immediately and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement or convulsions. Take regular breaks. Some motion and visual effects can be reduced in the Game's settings.
17. Ending this Agreement
17.1 This Agreement lasts until it is ended. You may end it at any time by uninstalling the Game and deleting all copies.
17.2 We may end or suspend your licence, or your access to Online Features, if you seriously or repeatedly break this Agreement. Where reasonable, we will first tell you what the problem is and give you a chance to put it right.
17.3 When the Agreement ends you must stop playing the Game and delete it. Sections 4, 6.2, 11, 12, 13, 14, 19 and 20 continue to apply after it ends.
18. Changes to this Agreement
We may update this Agreement to reflect changes in the law, in the Game or in our Online Features. We will show the updated version on the Game's store page or in the Game, with a new "last updated" date. If a change materially affects you, we will tell you before it takes effect; if you do not accept it, you may stop using the Game. Changes will not apply retrospectively.
19. Governing law and disputes
19.1 This Agreement is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute about it.
19.2 If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in your local courts where that law allows.
19.3 Please contact us first (section 21) — most problems can be sorted out quickly without any dispute.
20. General
20.1 Entire agreement. This Agreement and the Platform's terms are the whole agreement between you and us about the Game.
20.2 Severability. If a court decides any part of this Agreement is unlawful or unenforceable, the rest stays in force.
20.3 No waiver. If we do not enforce a right straight away, we can still enforce it later.
20.4 Transfer. We may transfer our rights and obligations under this Agreement to another organisation (for example if the Game is sold), and we will tell you if we do; this will not reduce your rights. You may not transfer your rights under this Agreement.
20.5 Third parties. Apart from our licensors under section 14.2, no one other than you and us has any right to enforce this Agreement.
